Associa Nevada South Clears Up Community’s Easement and Power Structure Issues

This 98-unit sub-association community is located in Henderson, Nevada. Associa Nevada South has been managing this community since 2021.

Challenge:

The community’s board of directors faced many struggles with the master association over-stepping power in different areas of the community—especially with easement and maintenance responsibilities.  

Resolution:

After learning about the easement and maintenance issues, the Associa Nevada South spent countless hours reviewing documents and minutes from prior management to find a solution. After many attempts to resolve challenges with the master association, the management team and board determined that seeking legal counsel was the best course of action. The Associa Nevada South team immediately brought in a well-known HOA attorney to remedy the situation. The new attorney quickly drafted a new easement agreement that was easy to interpret and clearly outlined a proper power structure. While the master association did not approve the new agreement, it was a step in the right direction, as both the master association and sub-association now clearly understand the other’s powers, responsibilities, and abilities. The sub-association’s board is pleased with the assistance and guidance they received from Associa Nevada South and looks forward to a successful partnership.
